This Privacy Policy explains how eTuning processes data related to the website, license purchase and activation, eTuning for Windows, mobile apps, cloud backups, technical support and connected eTuning services.

1. Controller and contact

The data controller is eTuning. For any privacy, data protection or rights request, you can write to etuning.app@gmail.com.

In this policy, eTuning, we, the website, the application or the service refer to the services provided under the eTuning brand.

2. Scope of this policy

This policy applies to etuning-app.com and pages associated with the eTuning service, checkout, license activation, eTuning for Windows, mobile apps, user-created backups, technical support, logs sent voluntarily and the Local Help feature.

Local Help allows eTuning users to offer help with a Shimano interface to other users, in person or by shipping, lending or renting by mail, when the user decides to publish that help.

3. Data we may process

Depending on the features you use, we may process the following categories of data:

  • Application technical data: version, platform, language, license status, errors, technical logs sent voluntarily and data required to keep the service secure.
  • Connected bike or system data: motor serial number, detected models, firmware, technical parameters read and status required to verify compatibility, license, backups or available functions.
  • Purchase or license data: license identifiers, associated motor, activation status, date, amount, purchased product and data received from payment providers or platforms when required to validate the purchase.
  • Backups: backup name, saved technical parameters, source, date and associated motor serial number. Backups are intended to contain technical bike configuration, not direct personal data about the user.
  • Support: messages, screenshots, logs or files that you voluntarily send us to resolve an issue.
  • Local Help: profile type, country, city, postal code, address if you are a workshop or business, email, phone, website if provided, schedule, type of help offered, available cables, price type, fixed price if selected, consent, source and associated motor serial number.
  • Browsing data: basic technical access information and, if you accept analytics cookies, usage data processed through analytics tools such as Google Analytics.

4. Why we use data

We use data to provide and maintain the service, verify licenses, associate certain functions with a specific motor, create and restore backups, provide support, diagnose errors, prevent fraud or abuse, comply with legal obligations, manage payments and enable Local Help when the user activates it.

We do not sell personal data and we do not use it for external advertising. eTuning does not send newsletters or general commercial communications unless the user requests or expressly consents to them in the future.

5. Legal basis

We process data on the following legal bases, depending on the case:

  • Performance of a contract or requested service: when we verify a license, provide paid features, store backups, activate functions associated with a motor or respond to support.
  • Consent: when you publish Local Help, provide contact details for that feature, send logs voluntarily, accept analytics cookies or agree that certain data is shown inside the app.
  • Legitimate interest: for security, fraud prevention, error diagnosis, reasonable service improvement and protection of the application.
  • Legal obligation: when we must keep or disclose information under an applicable rule, for example tax, accounting, consumer or valid authority requirements.

6. Payments and licenses

Payments may be processed by secure external providers, payment gateways or native app distribution platforms. eTuning does not directly store full card details when payment is made through an external provider.

We may receive and keep the information needed to validate the purchase, activate the license, check its status, manage issues, prevent fraud and comply with legal obligations. The license is linked to the serial number of the corresponding motor.

7. Cloud backups

Backups allow you to save and restore technical configurations for a compatible bike or motor. These backups may include technical parameters, creation date, backup name, source and associated motor serial number.

Backups are kept while the user keeps them active or while they are necessary to provide the service. The user can delete them using the available eTuning functions.

8. Local Help

If you publish Local Help, some data may be shown inside eTuning so that other users know what help you can offer. This may include country, city, area, profile type, type of help, available cables, price, schedule, website or business address where applicable.

Your email and phone number are not shown on an open website or to anyone simply visiting the website. They will only be shown inside eTuning to users using the app in the context of looking for help.

The help is linked to the serial number of the motor from which it is published. Each motor can have one active help listing. You can edit or remove the help from eTuning for Windows, which is the application used to publish it, or by requesting it by email at etuning.app@gmail.com.

Local Help data may remain pending manual review before being shown to other users. This review aims to reduce incorrect data, abusive content, spam, fake profiles or information that may harm other users.

The review does not make eTuning a party to any agreement between users. eTuning does not guarantee the availability, quality, price, safety, legality or compliance of help offered by third parties.

9. Technical support and voluntarily sent logs

If you contact support, we process the information you provide to analyze and respond to the issue. This may include messages, screenshots, technical data, motor serial number, license status or logs that you decide to send us voluntarily.

You should avoid sending personal data, private documents or sensitive information that is not necessary to resolve the issue.

10. Analytics, cookies and website

The website may use technical cookies required for operation and, if the user accepts them, analytics cookies to understand website usage and improve the service. For analytics we may use tools such as Google Analytics.

11. Recipients and providers

We may use technical providers needed to operate the website, host services, store data, process payments, send necessary communications, analyze errors, measure website usage or provide support. These providers must process data only for the stated purposes and under eTuning instructions when they act as processors.

We may also disclose data if required by law, a competent authority or a valid legal process.

12. International transfers

Some providers may be located outside the user’s country or outside the European Economic Area. Where applicable, eTuning will seek to use appropriate safeguards for international data transfers, such as adequacy decisions, standard contractual clauses or other mechanisms recognized by applicable law.

13. Data retention

We keep data for as long as necessary for the relevant purpose. Licenses associated with a motor may be kept while the license is active or while it is necessary to verify it. Backups are kept until the user deletes them or until they are no longer necessary to provide the service.

Support data is kept for the time needed to manage the issue and maintain a reasonable support history. Purchase and billing data may be kept for the periods required by applicable rules. Local Help data is kept while the help listing is active or until the user requests removal.

If you remove Local Help, the listing and its contact data stop being available and are permanently deleted from eTuning servers, unless a specific legal obligation requires keeping minimal evidence for the strictly necessary time.

14. Security

We apply reasonable technical and organizational measures to protect data against unauthorized access, loss, alteration or misuse. Among other measures, certain communications with eTuning services may use authentication, signing, encryption or equivalent security controls.

No system is absolutely secure. The user must protect their device, email, connection and any information they decide to share with other users.

15. User rights

Where applicable law allows, you may request access, rectification, deletion, objection, restriction of processing, portability and withdrawal of consent. You can exercise these rights by writing to etuning.app@gmail.com.

Withdrawing consent does not affect processing carried out before withdrawal or data that must be kept due to a legal obligation or another applicable lawful basis.

If you believe that the processing of your data does not comply with the rules, you may file a complaint with the Spanish Data Protection Agency or the relevant supervisory authority.

16. Minors

eTuning is not directed at minors. If we detect that personal data from a minor has been sent without a valid basis, we may delete it.

17. Automated decisions

We do not use data to make automated decisions with legal effects on the user or to create advertising profiles.

18. Changes to this policy

We may update this policy for legal, technical or operational reasons. The current version will be available on the official eTuning website and, where appropriate, through the official application channels.

The main version of this policy is the Spanish version. If translations are published in the future and there is any discrepancy, the Spanish version will prevail.
